Recording Artists Outraged at Money Grab by Corporate Webcasters

Recording Artists Outraged at Money Grab by Corporate Webcasters

Senate Bill Would Enrich Mega-Corporations Like Clear Channel and AOL As Much As $100 Million at the Expense of Artists and Record Labels

WASHINGTON, May 11 /PRNewswire-USNewswire/ -- In a blatant attempt to strip artists and record labels of their hard-won royalties for the use of their sound recordings on Internet radio, proposed legislation in the U.S. Senate would not only invalidate the March 2, 2007 ruling of the Copyright Royalty Board (CRB), it would roll back by 70 percent pre-decision rates
already paid by webcasters.
An analysis by SoundExchange shows that the proposed rollback in royalties would save big, highly profitable corporations like Clear Channel, Yahoo!, AOL and Microsoft $100 million or more in royalty payments during the rate period 2006-2010, and that's only if there is no growth in listeners. However, expected growth in listeners during the period will result in an even greater windfall.
"This legislation is a money grab by big corporations like Clear Channel and AOL at the expense of artists and labels," said John Simson, Executive Director of SoundExchange. "I don't see any other way to characterize this as anything other than naked corporate greed. It's just not fair to artists."
Under the proposed legislation SoundExchange's analysis shows that, for 2006, $12 million in royalties would have to be paid back to the 20 largest webcasters. By contrast, under new rates set by the CRB, those same webcasters would owe only $850,000 in retroactive royalty payments for 2006. The windfall to big webcasters is even more dramatic in 2007 when, assuming no growth in listeners, the 20 largest webcasters would owe $24 million in royalty payments, but under the proposed legislation, would only owe $5 million to the people who create the music upon which they build their businesses.
The legislation is being driven by the SaveNetRadio coalition. Though the coalition purports to represent some artists and some small webcasters, it is in fact funded by the big webcasting industry. Supporters of SaveNetRadio have been mislead into thinking that advancing this legislation would somehow help small webcasters and artists, when, in fact it would give more money and power to the big webcasting industry. "The fact that they would advance the profit-grinding agenda of big webcasters without regard to the artists they are hurting speaks to SaveNetRadio's true mission and evident hypocrisy," said Rebecca Greenberg, National Director of the Recording Artists' Coalition. "If SaveNetRadio really cared about artists, they wouldn't be fronting for the big webcasters like this."
Simson noted, "There are better, targeted ways to help the small webcasting businesses without resorting to selling out to the likes of Clear Channel." In fact, SoundExchange has told Congress that it is actively engaged in seeking business solutions that could accommodate the needs of small webcasters while protecting the hard-won, fair royalties that artists deserve.
This bill, introduced in the House by Reps. Jay Inslee (D-WA) and Donald Manzullo (R-IL), and now in the Senate by Sens. Ron Wyden (D-OR) and Sam Brownback (R-KS), would arbitrarily reverse the painstaking work of the CRB, the three-judge panel created by Congress at the request of the webcasters three years ago. The CRB panel listened exhaustively for 18 months to all interested parties, heard from dozens of witnesses in weeks of live hearings, read countless depositions and examined tens of thousands of pages of evidence focused on, among other things, the services' ability to pay and the value of music in the marketplace. In contrast, the proposed bill presents no factual or economic basis for rejecting the reasoned decision of the CRB. This legislation, if passed, would come at the expense of hard-working artists, who, on average, received just $360 each in royalties from webcasting in 2006.
"Asking Congress to override a valid, objective process that Congress created while arbitrarily dismissing the painstaking work of these expert judges who clearly determined a fair rate for artists and labels that these webcasters can clearly afford makes no sense," added Simson.

Spinner.com: Courtney Plans to Sell Kurt's Stuff

Spinner.com/Original article

Posted Apr 30th 2007 10:00AM by Steve Baltin
Filed under: News, Album, Exclusive

Thirteen years after Kurt Cobain's death, Courtney Love is making a commitment to move on, by selling her late husband's belongings.

"I'm going to have a Christie's auction," she tells Spinner. "[My house] is like a mausoleum. My daughter [14-year-old Frances Bean] doesn't need to inherit a giant hefty bag full of flannel f***ing shirts ... A sweater, a guitar and the lyrics to 'Teen Spirit' -- that's what my daughter gets. And the rest of it we'll just f***ing sell."

Love says her friends are supportive of the idea. "Everyone's been positive and behind me on it," she says. "We'll make a lot of money and give a bunch of it to charity."

On Love's upcoming confessional album, 'Nobody's Daughter,' she opens the Pandora's box that is her past relationships, which include rockers Trent Reznor and Billy Corgan, and actor Edward Norton. While some in the media have speculated that the entire album was inspired by a recent unnamed paramour, Love says that's not the case. "There are two songs that are specifically about this guy; the rest of them have bits of Kurt, bits of Edward, bits of lots of people in them."

'Sunset Marquis' -- a song that rises from an acoustic intro into a pop/rocker with a Zeppelin-esque tinge, then culminates in vintage Love emotion as she screams, "You're the dance of my despair" -- is based on multiple experiences at the hotel of the same name, including some with Cobain. "Me and Kurt stayed at the Sunset Marquis a lot," she says.

Love says Cobain's impact on her is still considerable. "I still wear his pajamas to bed," she says. "How am I ever going to go form another relationship in my lifetime wearing Kurt's pajamas?"

Rap lyrics, Brown funeral expenses, Van Halen, Notorious B.I.G. family sues L.A., Nuge robbery, RS turns 40, more

By Art Shimko
shimko_7@hotmail.com

-- Music news and notes from the last few days...

-- As many people brought up in the wake of the Don Imus controversy, myself included, rap lyrics has its share of misogynistic and racist lyrics which are a detriment to the fans who purchase and consume such swill on a regular basis as well as impressionable youth and society. Well the subject was addressed recently as rap mogul Russell Simmons' Hip-Hop Summit Action Network organized a meeting at [chairman and chief executive of U.S. music at Warner Music Group] Lyor Cohen's New York home to "discuss issues challenging the industry in the wake of controversy surrounding hip-hop and the First Amendment" which lasted hours without any conclusion. Those who attended included: Kevin Liles, executive vice president, Warner Music; L.A. Reid, chairman of Island Def Jam Music Group; Sylvia Rhone, president of Motown Records and executive vice president of Universal Music Group; Mitch Bainwol, chairman and CEO of the Recording Industry Association of America; and Damon Dash, Jay-Z's former Roc-A-Fella Records partner and rapper T.I. Simmons was on The Oprah Winfrey Show admitting there was a problem with rap lyrics but rappers' free speech shouldn't be stifled: "We're talking about a lot of these artists who come from the most extreme cases of poverty and ignorance ... And when they write a song, and they write it from their heart, and they're not educated, and they don't believe there's opportunity, they have a right, they have a right to say what's on their mind," he said. "Whether it's our sexism, our racism, our homophobia or our violence, the hip-hop community sometimes can be a good mirror of our dirt and sometimes the dirt that we try to cover up," Simmons said. "Pointing at the conditions that create these words from the rappers ... should be our No. 1 concern." Al Sharpton too wants in on the action and plans on challenging the industry and rap lyrics by deciding to not honor Def Jam artist L.A. Reid at his National Action Network convention in New York this week. I'm really all for free speech and artists' freedom of expression, what's considered art is always a moot point and I'd never want to see anyone's right to express their feelings in song lyrics yanked away but at the same time this issue needs to be addressed, because chastising a white guy for saying something considered by some to be racist while giving black people and rappers carte blanche to say those same words is bullshit. If you want respect, you need to respect yourselves and learn to respect others, it's really a simple lesson when you think about it.

-- Things never seem to end of James Brown, while the legendary singer died late last year his estate now owes $70,000 for the funeral services from Brown's burial back in March. "I'm just waiting on them to get some of this mess straightened out," said Charles Reid, manager of the C.A. Reid Funeral Home in Augusta, Ga., which handled Brown's funeral. "I really haven't pushed the issue, even though I'd like to have my money." According to Brown's trusted advisor Buddy Dallas a portion of the funeral costs where paid for by trustees but that Brown's children ran the bill up to $150,000. Louis Levenson, an attorney for Brown's six adult children stated that it was the trust's responsibilty to pay the bill saying it was a "reasonable" amount, also the children filed a motion to disclose acccounting records of their father's trust and estate before and after his death claiming the trustees tried to sell off Brown's assets against court orders and filed a motion asking a judge to change his ruling putting two special administrators watching the estate so that the children would have more control over the estate. A hearing is scheduled later this month to settle this and other bullshit with Brown's estate.

-- Speaking of never-ending sagas... The family of Christopher Wallace AKA Notorious B.I.G. are filing a second wrongful-death suit against the city of Los Angeles accusing rogue police officers of shooting and killing the rapper ten years ago. The suit is seeking unspecified damages for Wallace's widow, mother and two children. Former L.A. cop Rafael Perez and his ex-partner, Nino Durden were named in the suit as the men responsible for Wallace's death and the suit also claims that Perez was in cahoots with Death Row Records and Marion "Suge" Knight who denied responsibility for Wallace's death. The L.A. police department wouldn't comment on the suit.

-- Ronald "Tenad" Washington was identified by federal prosecutors an armed accomplice of a second unidentified gunman involved in the 2002 shooting death of Run-DMC member Jam Master Jay (Jason Mizell) inside his Queens recording studio. Washington is suspected of fatally shooting Tupac Shakur associate Randy Walker which he denies any involvement with as well as any connection with Jay's murder claiming that detectives forced him to fessing up about the murders and other crimes. A spokesperson for the Mizell family said, "We're relieved there's some information coming out, although we understand that it's not the full story."

-- Well it turns out that the bottle of Dr. Bronner's Magic Soap found in Germs drummer Don Bolles' car earlier this month did not in fact contain GHB as originally detected in a field drug test kit by the Newport Beach Police. A Orange County crime lab confirmed that no GHB (Gamma Hydroxy Butyrate) was detected. Bolles is scheduled to appear in court on 5/18. "Mr. Bolles charges of felony drug possession charges have been proven false," said David Bronner President of Dr. Bronner's Magic Soaps. "It's shocking that the DA's office is sitting on the lab results on the soap and hasn't dropped the charges already. Mr.Bolles has always been innocent in this case, but as long as these charges are pending he may not get a passport to travel out of the country to perform and is in major legal jeopardy," said Bronner who appeared in court last Friday to support Mr. Bolles. Bolles is scheduled to tour with The Germs this summer in Europe.

-- Eddie Van Halen makes his first post-rehab appearance on Friday during pre-race events at the Subway Fresh Fit 500 NASCAR Nextel Cup Series event in Phoenix introducing a limited-edition series of Fender Stratocaster guitars and will be on hand to greet the drivers as they are introduced prior to race on Saturday.

-- A Concord Township, MI teenager confessed and was jailed for robbing Ted Nugent's home last week, among the items retrieved by local police were two all-terrain vehicles and two hunting crossbows. Police are looking for another teen involved in the crime. I hate The Nuge but seriously, you don't want to fuck with that guy.

-- Rolling Stone magazine is marking its 40th anniversary this year with three upcoming special issues. The first due out this week contains interviews with Bob Dylan, Mick Jagger, Paul McCartney and Steven Spielberg and others. The second issue, due out in June will focus on the Summer Of Love of 1967 and the third issue due out in November will focus on the future of music.

-- Mick Jagger, Eric Clapton, Stevie Nicks, and Crosby, Stills, Nash & Young were among the many artists who gathered at Lincoln Center in New York on Tuesday night to honor the late Atlantic Records chairman Ahmet Ertegun who died last December.

-- Boy Sets Fire will hold its final gig ever at Philadelphia's Trocadeo on 6/9. Go to www.myspace.com/bsflastshow for more info.

-- Bob Dylan's XM Satellite Radio show Theme Time Radio Hour will return for a second season in September. XM will air a Memorial Day Weekend marathon beginning at 6PM EST on 5/26 on channel XM 15 (The Village).

No jail time for Anastasio

By Art Shimko
shimko_7@hotmail.com

-- On Friday former Phish guitarist Trey Anastasio pleaded guilty in a Fort Edward, N.Y court to attempted criminal possession of Vicodin, Percocet, heroin and Xanax found by police during a traffic stop last December.

Anastasio will be avoiding jail time by entering a drug court program in which he'll undergo weekly court appearances, drug tests and perform community service. If Anastasio completes the program he'll get five years probation but if he fucks up and falls off the wagon he'll get three years behind bars.

"He's accepted responsibility," said Washington County District Attorney Kevin Kortright. "That's all we can ask for."

-- U.S. District Judge Paul A. Magnuson ruled last week that Collier County deputies didn't use excessive force in subduing Rush guitarist Alex Lifeson (Alex Zivojinovich) and his son Justin at a New Year's Eve 2003 party at the Ritz-Carlton in Naples, FL. Justin had been escorted by deputies from the hotel after he'd attempted to climb onto the platform where the house band performed. "The cleaner removed the photographic material and disposed of it by placing it for compaction in a waste compactor and collection by refuse collectors," the lawsuit says. "The compacted waste was removed by refuse collectors, and despite EMI's best efforts, the photographic material was irretrievably lost."

I went to see my doctor, and while the good news is that it's not broken, the bad is news is it's severely sprained and I may have done some ligament damage. Richards Denies Snorting Dad, Metallica: Baby Name? Outlaw Billy Joe, Rap death, Kiss passing, Fall Out Delay, tons more

By Art Shimko
shimko_7@hotmail.com

-- A day after telling music magazine NME that he snorted his father's ashes with some blow, Keith Richards denied the story saying it was just a joke. Years ago when asked about his rumored blood transfusion in 1973, Richards "admitted" it happened only later to confess, "I was just fooling around," he admitted, years later. "I was fucking sick of answering that question." Richards enjoys messing with the press but sometimes forgets how he's percieved by the public and press (you know, the partying and such).

-- Michael and Karolina Tomaro are in court with the Swedish National Tax Board who refuse to accept the couple's application to name their six-month-old daughter Metallica (no that's not a typo). "It suits her," Karolina Tomaro, 27, said Tuesday of the name. "She's decisive and she knows what she wants." Besides the name being associated with the rock group and the word metal, Swedish authorites ruled the name as being ugly. The County Administrative Court in Goteborg ruled in favor of the couple stating that there wasn't a reason to block the use of the name and noted that there was a woman living in Sweden with Metallica for a middle name. The tax board took the case to a higher court thus making travel plans for the family difficult as they can't get a passport for the baby without an approved name.

-- Billy B. Coker, who according to authorities was shot and wounded by country singer Billy Joe Shaver, says the attack was unprovoked and at least by one witness account Shaver followed Coker out of Papa Joe's Texas Saloon in Lorena, TX last Saturday night and asked Coker "Where do you want it?" before Shaver shot him in the face. Joseph A. Turner, Shaver's attorney, says it happened otherwise as Coker was being aggressive, had a knife and followed Shaver outside the Saloon although witness statements don't say so. Shaver surrendered last Tuesday and posted $50,000 bail, he was charged with charged with aggravated assault with a deadly weapon and unlawfully carrying a handgun on the premises of a business with a license to sell alcohol for on-premises consumption.

-- A member of the Mexican rap group Cartel de Santa was shot and killed last weekend by accident when lead singer Eduardo Davalos de Luna shot at the group's driver, Juan Miguel Chavez. Davalos de Luna shot at Chavez injuring his leg and another shot ricocheted off the floor killing band member Ulises Nayit Buenrostro.

-- Former Kiss guitarist Mark St. John (Mark Norton) died of a brain hemorrhage earlier this week at age 51. Mark St. John replaced guitarist Vinnie Vincent in 1984, shortly thereafter he developed a form of arthritis called Reiters Syndrome. Bruce Kulick came in to cover for St. John on the Animalize tour and as the condition worsened St. John left Kiss in December 1985. St. John later formed the band White Tiger and also recorded a solo album as well as a demo with former Kiss drummer Peter Criss.

-- Due to "personal issues" Fall Out Boy announced Friday that the first few weeks of the Honda Civic Tour will be delayed with the tour beginning on 5/11 at Denver's Coors Amphitheater. According to bassist Pete Wentz the band "just wanted to give everyone a heads up, we are planning on this being the biggest and best Fall Out Boy show that we could possibly have. Unfortunately, because of some personal issues we had to delay the tour a few weeks. We want to put on the best possible show we can and know that this extra couple of weeks will give us the time to put ourselves in the right place to put on the best show we can. The shows from the earlier part of the tour will be rescheduled to the end but all tickets will be honored for all moved shows. Again we apologize. Our fans really mean the world to us and I promise the wait will be well worth it." Only the Sacramento show was canceled, tickets for that show can either be refunded or exchanged for the 6/30 Concord show.

The hotel is pressing charges for the damages stemming from this incident... but that's not all...

Music news and notes 3/24/07

-- The National Music Publishers' Association filed a lawsuit against XM Satellite Radio claiming the station is violating copyright laws by providing its customers with a service called XM+MP3 which lets listeners store songs on XM portable players with the option to by played anytime, also the saved songs are active for as long as a subscription lasts (cost about $13/year). A spokesman for XM said the lawsuit by the NMPA "simply represents a negotiating tactic to gain advantage in our ongoing business discussions." The publishers group also sees the XM+MP3 service as a substitute for using iPod-type devices and services like iTunes to purchase music. What the NMPA fails to understand is that the customer is already PAYING for the XM service, this would be seen as a perk plus once a subscription ends you no longer have possession of those saved tracks. The music industry is full of dipshits.

"Snoop and his team are mystified at the decision and are hoping that the British government will reconsider this decision," spokeswoman Celena Aponte said in a statement. "He has asked how he can help rectify the situation and would happily talk to and give assurances to the officials." The Home Office wouldn't comment specifically on the reason Snoop was denied a visa but a statement released stated, "The Home Secretary has the power to refuse entry clearance to non-U.K. citizens if he considers that their presence here would not be conducive to the public good." P Diddy will play the Wembley Arena on Tuesday.

BRAD DELP, LEAD SINGER OF BOSTON, DEAD AT 55

By Art Shimko

We've just lost the nicest guy in rock and roll.

-- We are sad to report the death of Brad Delp who was the lead singer for veteran rock group Boston since the 1970's when the band formed. Delp was found on Friday in his Atkinson, N.H. home, foul play has been ruled out and an investigative report on his cause of death will be released on Monday.
Born 1951 in Danvers, MA, Delp's love for the Beatles as a teen lead him to sing in bands and eventually met MIT student and future Boston leader Tom Scholz. Scholz recruited Delp along with other musicians recorded demo tapes which caught the attention of CBS Records and went on to record their 1976 self-titled debut album that sold 17 million copies ranking it the best selling debut in US history.
In a Musician Magazine interview with Scholz in 1986 he said about Delp, “The nice thing about Brad was his incredible ability in the studio. He was a master at controlling his voice — he could do things over and over, changing one note and doing everything else the same. He’s a natural overdubber, he can perfectly match what’s on tape, he can sing harmonies with himself and keep dozens of parts in his mind.”
Delp has a distinct voice that really fit the sound of Boston and provided a blueprint for future rock singers to refer to as how a perfect rock vocalist sounds.
Between Scholz taking a long time writing material for a follow-up to 1978's Don't Look Back and further delay by a lawsuit filed by CBS, Delp went off to record albums with fellow Boston member Barry Goudreau and the group RTZ, Delp returned to the group in 1985 for Third Stage (the follow-up to Don't Look Back) and again left before returning in 1994 for the Walk On tour although he did not sing on that album.
Delp remained with Boston up to their 2002 Corporate America album and tour.
Boston was one of the first rock bands I ever heard thanks to my father and recently we were talking about hearing of a possible Boston tour and how we both hoped to see them live. Well looks like that's not happening, and if Scholz does decide to tour with a new singer it just won't be the same. We here at Strong Style Shimko send condelences to Delp's family and friends. -- Eddie Van Halen released a statement on Van Halen's website on Thursday:
I would like Van Halen fans to know how much I truly appreciate each and every one of you. Without you there is no Van Halen.

I have always and will always feel a responsibility to give you my best. At the moment I do not feel that I can give you my best. That’s why I have decided to enter a rehabilitation facility to work on myself, so that in the future I can deliver the 110% that I feel I owe you and want to give you.

Some of the issues surrounding the 2007 Van Halen tour are within my ability to change and some are not. As far as my rehab is concerned, it is within my ability to change and change for the better. I want you to know that is exactly what I’m doing, so that I may continue to give you the very best I am capable of.

I look forward to seeing you in the future better than ever and I thank you with all my heart.

Love,

Ed

So Eddie's headed to rehab meaning this further delays any plans for a supposed reunion tour.

Music News & Notes 3/7/07

By Art Shimko
shimko_7@hotmail.com

-- We are back with a long-overdue music news update...

-- James Allen (Al) Hendrix and his company Experience Hendrix are suing Craig Dieffenbach for trademark infringement by using the late Jimi Hendrix in an unauthorized and quite frankly disgusting manner to sell his line of Electric Hendrix vodka. Dieffenbach (perhaps German for cunt face?) told the L.A. Times this about his Electric Hendrix vodka: "It's like drinking with Jimi. The drunker you get, the more you think you're with him." Quite the ignorant and delusional statement if I've ever heard one. Dieffenbach has also used photos of Hendrix and his band The Experience without permission for advertising campaigns, and drummer Mitch Mitchell had this to say, "I find this despicable. I have never been consulted about the use of my image and reputation in association with any advertisement for this product. This is repulsive and something I would never endorse under any circumstance. Jimi must be turning over in his grave over this." Yeah, to say the least.

-- Amongst 25 historic and important recordings chosen by the Library of Congress to be included in the National Recording Registry for 2006 were Paul Simon's Graceland, Bob Marley and the Wailers' Burnin' The Wailers, Velvet Underground and Nico, Rolling Stones' (I Can't Get No) Satisfaction and Franklin D. Roosevelt's address to Congress on Dec. 8, 1941 (day after the Pearl Harbor attack).

-- Trey Anastasio pleaded not guilty to DWI and felony drug possession charges in Washington County Court on Last Tuesday. "If there has to be a plea which there may have to be, Trey has made it very clear to me he's not interested in claiming any police misconduct because there was none. He's interested in getting treatment. He's had treatment. He's been in a 28-day facility. He wants to put this behind him", said [Anastasio's attorney Steve] Coffey. On 3/27 a pre-plea report is due, no word yet on if Anastasio will have to appear in court.

-- Bono's RED campaign isn't doing so hot, the worldwide sales for its products with proceeds going to various charities have been $18 million while $100 million has been spent on advertising. A representative stated that not all companies involved have tallied their 2006 profits yet and that more money should pour into the company over time.

-- On Def Leppard's website it was revealed that the band will be touring with Foreigner and Styx in North America this year, probably in the summer is my guess.

-- Heaven And Hell (Black Sabbath fronted by Ronnie James Dio) start a 20-city U.S. spring tour beginning 4/22 in Phoenix concluding May 19 in Holmdell, N.J.

-- Blender has a video interview with Slayer's Kerry King.

-- A documentary on guitar great Randy Rhoads will begin filming on 3/19 at the Mountain View Cemetery in San Bernardino, CA. For more info visit www.myspace.com/randyrhoadsfilm.

-- The Rock on the Range festival on 5/19 at the Columbus Crew Stadium in Columbus, OH will feature ZZ Top, Evanescence, Velvet Revolver, Hinder, Chevelle, Three Days Grace, Breaking Benjamin, Papa Roach, Buckcherry, Puddle Of Mudd, the Operator and Black Stone Cherry.

-- Tool will back on the road with a set of rescheduled dates:
April 30 - Reno @ Reno Event Center
May 2 - San Diego @ Cox Arena
May 5 - Las Cruces @ Pan American Center
May 6 - Tucson @ Convention Center Arena
May 8 - Albuquerque @ Tingley Coliseum
May 15 - Southaven @ DeSoto Center
May 19 - Oklahoma City @ Ford Center
May 21 - San Antonio @ AT&T Center
May 22 - Corpus Christi @ American Bank Center
May 24 - Baton Rouge @ River Center
People can exchange their original ticket(s) for the new show.
